These Terms of Use ("Terms") govern your access to and use of the EASYFAXES app for ChatGPT and related services (the "Service"), provided by Easyfaxes ("Easyfaxes", "we", "us"). By using the Service, you agree to these Terms.

1. The Service

EASYFAXES lets you upload a document, provide a recipient fax number, send a fax, and check delivery status. The Service may use third-party telecommunications and delivery providers to transmit faxes.

2. Eligibility and authority

You must be able to form a binding contract where you live and comply with applicable laws. If you use the Service on behalf of an organization, you represent that you are authorized to do so.

3. Your responsibilities

You agree that you will:

  • Send faxes only to numbers you have permission to contact and only for lawful purposes.
  • Ensure the content you upload is appropriate and does not violate privacy, confidentiality, or intellectual property rights.
  • Not use the Service to send spam, harassment, or unlawful content.
  • Not attempt to interfere with, misuse, or reverse engineer the Service.

4. Confirmation before sending

The Service is designed to require a clear user intent to send before transmitting a fax. You are responsible for reviewing the recipient number and document before confirming send.

5. Delivery and limitations

Fax delivery depends on recipient systems, telecommunications networks, and third-party providers. We do not guarantee that every fax will be delivered successfully or within a specific time. Status information is provided on a best-effort basis.

6. Content and license

You retain rights to the content you upload. You grant Easyfaxes a limited license to process your content solely to operate the Service, including transmitting the fax and providing delivery status. Our privacy practices are described in the Privacy Policy.

7. Acceptable use and enforcement

We may suspend or restrict access to the Service if we reasonably believe you are violating these Terms, creating risk, or using the Service abusively. We may also comply with lawful requests from authorities.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASYFAXES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASYFAXES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASYFAXES' TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO USE THE SERVICE IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (IF ANY).

10. Termination

You may stop using the Service at any time. We may discontinue or modify the Service, or terminate access, as described above.

11. Changes to these Terms

We may update these Terms from time to time. We will update the date at the top when we do. Your continued use of the Service after changes become effective means you accept the updated Terms.
